- — Membership is free. Buying bags requires a verified account and you must be 18+.
- — Payments are processed by Stripe Payments Europe, Ltd., acting as our Merchant of Record for transactions where this is enabled. Stripe is the legal seller of record for tax and chargeback purposes on those transactions.
- — EU/UK consumers have a 14-day right of withdrawal on most items. Authenticated personalised or custom-finished items are exempt under Art. 16(c) CRD.
- — All items are sold "as inspected" — pre-owned, with documented condition. We authenticate every bag.
- — Giveaways are random draws; no purchase necessary.
- — We are not affiliated with any luxury brand. Trademarks belong to their owners.
- — To the fullest extent the law allows, you agree to limit and waive any liability claim against us — see Sections 9, 10 and 11.
1.Acceptance of terms
By accessing, browsing, registering for, or otherwise using The Archival Club website, mobile experience, or any related services (collectively, "the Service"), you enter into a binding contract with us and agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and any policies referenced herein. If you do not agree to every clause, you must immediately stop using the Service. Your continued use after any update constitutes acceptance of the revised Terms.
2.Eligibility & membership
You must be at least 18 years old, have full legal capacity to enter into binding contracts in your jurisdiction, and not be barred from receiving services under applicable law (including EU, UK, US, and UN sanctions lists). Membership is free and granted upon successful email verification. We reserve the right, at our sole discretion, to refuse, suspend or terminate any account that violates these Terms, engages in fraudulent, abusive, or unlawful activity, or that we reasonably believe poses a risk to other members or the Service.
3.The archive, orders & pricing
The Archive is a curated selection of authenticated pre-owned luxury bags. Each listing includes condition notes, provenance details, and photographs. All items are unique, pre-owned, and sold "AS IS, WHERE IS" subject only to the authentication guarantee in Section 5 and the statutory consumer guarantees of your country of residence that cannot be waived by contract. When you place an order:
- The listing is an invitation to offer. Your order is an offer. A binding contract is formed only when we send the order confirmation email.
- You commit to pay the listed price plus any applicable shipping, duties, and taxes calculated at checkout.
- Prices are displayed in EUR and include VAT where applicable. Customs duties for non-EU destinations are the buyer's responsibility.
- We ship to the address you provide at checkout. You are solely responsible for ensuring it is correct, accessible, and lawful to receive the item.
- Risk of loss passes to you on delivery to the address you provided.
- We may correct pricing or stock errors and cancel affected orders with a full refund — caused, for example, by typos, currency-conversion glitches, or simultaneous sales of a unique item.
4.Payments & Merchant of Record
Payments on the Service are processed by Stripe Payments Europe, Ltd. ("Stripe"), 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland, under Stripe's own terms available at stripe.com/legal/consumer. By placing an order you also accept those terms with respect to the processing of your payment.
For transactions where this option is enabled at checkout, Stripe acts as the Merchant of Record (MoR). That means Stripe is legally the seller of record on the transaction and is responsible for:
- Calculating, collecting, filing and remitting sales tax, VAT, GST and similar consumption taxes in supported jurisdictions;
- Issuing the tax-compliant invoice or receipt for your purchase;
- Processing chargebacks, fraud reviews and payment-method disputes;
- Handling billing-related customer support (refunds, double charges, statement descriptors).
The Archival Club remains responsible for the item itself: sourcing, authentication, condition disclosure, packing, shipping, and any warranty obligations described in Section 5. Bank or card statements for these transactions may display Stripe's descriptor alongside our brand name.
For transactions where MoR is not enabled, The Archival Club is the seller of record and Stripe acts solely as our payment processor. The role applicable to your order is shown at checkout and on your invoice. We never store full card numbers or CVV codes on our infrastructure; card data is handled exclusively by Stripe under PCI-DSS Level 1.
5.Authentication guarantee
Every bag in the Club is independently inspected and authenticated by our partners before being offered. We guarantee the authenticity of every item sold through the Club for a period of 12 months from the date of delivery.
If a qualified, independent third-party authenticator (mutually agreed in advance) determines that an item is counterfeit, we will refund the full purchase price upon return of the item, original packaging, and the signed authentication report. This is your sole and exclusive remedy for authenticity disputes. The guarantee does not cover wear, patina, owner-applied modifications, or condition changes occurring after delivery.
6.Right of withdrawal (EU & UK consumers)
If you are a consumer resident in the EU or UK, you have the right to withdraw from the purchase contract within 14 days of delivery, without giving any reason, under Directive 2011/83/EU (Consumer Rights Directive) and the UK Consumer Contracts Regulations 2013. To exercise this right, email privacy@archival.club with your order number before the deadline.
The item must be returned in the exact condition it was delivered, in its original packaging and tags, within 14 days of your withdrawal notice. Return shipping is at your cost and risk. Refunds are issued within 14 days of our receipt and re-inspection of the item.
Exemptions (Art. 16 CRD): personalised, made-to-order, custom-restored, or sealed authentication-coffret items are excluded from the right of withdrawal once unsealed or once production has begun. Each affected listing flags this clearly.
7.Giveaways
The Club runs members-only giveaways from time to time. Participation is free and no purchase is necessary to enter or win. Winners are selected by random draw. Each giveaway has its own specific rules and eligibility criteria published at the time of the giveaway, which prevail over these Terms in case of conflict.
- One entry per person per giveaway unless otherwise stated.
- Winners are notified by email and must respond within 7 days, or an alternate winner may be drawn.
- Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash.
- Any tax or duty arising from the receipt of a prize is the winner's responsibility.
- We reserve the right to cancel, modify, or void any giveaway in case of fraud, technical failure, or force majeure.
8.Intellectual property & permitted use
All content on the Service — including text, images, logos, code, and design — is the property of The Archival Club or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, scrape, mirror, sell, or create derivative works without our express written permission.
The Archival Club name, logo, and the italic "a" mark are trademarks of The Archival Club. Third-party brand names (Hermès, Chanel, Louis Vuitton, Prada, etc.) are used solely under the doctrine of nominative fair use to identify the pre-owned items being offered. We are not affiliated with, sponsored by, or endorsed by any of these brands.
9.Disclaimers & warranties
To the maximum extent permitted by applicable law, the Service and all items are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, accuracy, non-infringement, or that the Service will be uninterrupted, secure or error-free.
Nothing in this Section excludes or limits any liability that cannot lawfully be excluded — including, for EU/UK consumers, the statutory conformity rights under Directive (EU) 2019/771, the rights under the Consumer Rights Directive 2011/83/EU and any equivalent national law, and liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation.
10.Limitation of liability
To the fullest extent permitted by law, you agree that neither The Archival Club, its parent, subsidiaries, founders, directors, employees, contractors, suppliers, or licensors shall be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages of any kind — including loss of profit, loss of goodwill, loss of data, business interruption, or substitute-procurement costs — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our aggregate liability for any and all claims relating to a given order or to the Service in any twelve-month period shall not exceed the greater of (a) the amount you actually paid us for that order, or (b) one hundred euros (€100). This cap applies in the aggregate to all causes of action, whether in contract, tort (including negligence), strict liability, statute, or otherwise.
We take security seriously and do everything reasonably within our power to keep your data hidden and safe — but no system on the public internet is invulnerable. If, despite our best efforts, we suffer an incident caused by a zero-day vulnerability in a third-party service, a state-level or otherwise sophisticated attacker, credentials compromised on your device or email account, or any other event beyond our reasonable control (force majeure), the limitations of this Section apply in full. We will still:
- Notify affected members within 72 hours, as required by Art. 33 GDPR.
- Notify the competent supervisory authority within the same window.
- Publish a clear post-mortem of what happened and what we changed.
- Provide guidance on protecting any affected accounts.
Nothing in this Section affects mandatory statutory rights of consumers that cannot be excluded under your local law.
11.Assumption of risk & release
You acknowledge that buying, selling, collecting, shipping and owning pre-owned luxury items inherently carries risk — including loss in transit, customs seizure, post-delivery damage, market value fluctuation, and changes in legislation. You expressly assume all such risks and, to the maximum extent permitted by law, release and forever discharge The Archival Club and all persons listed in Section 10 from any and all claims, demands or causes of action arising out of those risks, save where caused by our gross negligence or wilful misconduct.
12.Indemnification
You agree to indemnify, defend and hold harmless The Archival Club and the persons listed in Section 10 from and against any third-party claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms or any policy referenced herein; (b) your violation of any law or third-party right; (c) any content or information you submit to the Service; or (d) your misuse of any item purchased through the Service.
13.Prohibited conduct
You agree not to:
- Use the Service for resale arbitrage in breach of the listing's intended use, or for any unlawful purpose.
- Submit false identity, payment, or shipping information.
- Attempt to bypass authentication, security controls, rate limits, or scraping protections.
- Reverse engineer, decompile, or copy any part of the Service.
- Use the Service to launder funds, evade sanctions or duties, or to facilitate counterfeiting.
14.Force majeure
Neither party is liable for any failure or delay caused by events beyond reasonable control, including acts of God, war, terrorism, riots, pandemic, government action, sanctions, internet or power outages, carrier failures, or cyber-attacks. Affected obligations are suspended for the duration of the event.
15.Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 9, 10, 11, 12, 16 and 17 — and any other provisions that by their nature should survive — will survive any termination.
16.Dispute resolution
We would much rather solve a problem than escalate one. Before any formal claim, please email privacy@archival.club and give us 30 days to make it right.
EU consumers may also use the European Commission Online Dispute Resolution platform at ec.europa.eu/consumers/odr, and Italian consumers may refer disputes to the competent ADR body under Legislative Decree 130/2015.
17.Governing law & jurisdiction
These Terms are governed by the laws of Italy and the European Union. Any dispute shall be subject to the exclusive jurisdiction of the courts of Milan, Italy, without prejudice to the mandatory consumer-protection rights granted to you by the law of your country of habitual residence (Art. 6 Regulation (EC) 593/2008, "Rome I").
18.Changes to these terms
We may update these Terms from time to time. Material changes will be emailed to you at least 14 days before they take effect. The latest version always lives at this URL with a "Last updated" date at the top. Non-material changes (typos, clarifications) take effect on publication.
19.Severability, waiver & entire agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision shall be replaced by an enforceable one that most closely reflects the original intent. Failure to enforce any right is not a waiver of that right. These Terms, together with the Privacy Policy and any order-specific documents, constitute the entire agreement between you and The Archival Club and supersede all prior communications.
